Terms of Use

This term of use agreement governs your use of E-Lib4Alls collections, resources, web pages, or site. E-Lib4All may provide you with login credentials provided that you accurately complete any required application process. You may use your credentials to access only content you have been authorized to access. You are prohibited from recirculating your credentials to other people or organizations and interfering with E-Lib4All resources, including personnel, servers, etc., and other users' work. You agree to report any unauthorized use of your credentials promptly by email.

Some of the content available through E-Lib4All may be governed by local, national, and/or international laws and regulations, and your use of such content is solely at your own risk. You agree to abide by all applicable laws and regulations, including intellectual property laws, in connection with your use of the E-Lib4All. In using E-Lib4Alls site, collections, and/or services, you agree (a) not to violate anyone's rights of privacy, (b) not to act in any way that might give rise to civil or criminal liability, (c) not to use or attempt to use another person's password, (d) not to collect or store personal data about anyone, (e) not to infringe any copyright, trademark, patent, or other proprietary rights of any person, (f) not to transmit or facilitate the transmission of unsolicited email (spam), (g) not to harass, threaten, or otherwise annoy anyone, and (h) not to act in any way that might be harmful to minors. You agree that we may contact you from time to time with surveys or other questions regarding your opinions about and use of E-Lib4All, as well as with information we believe may be of interest to you. We encourage you to respond to these surveys because we value your input, which will assist us in improving E-Lib4All. Besides, we request that, according to standard academic practice, if you use E-Lib4All's collections for any research that results in an article, a book, or other publication, you list E-Lib4All as a resource in your bibliography.

While we collect publicly available Internet documents, if the author or publisher of some part of E-Lib4All does not want his or her work in our collections, we may remove that portion of the collections without notice. 

E-Lib4All may immediately terminate this agreement at its sole discretion at any time without written notice to you. Upon termination, you agree that E-Lib4All may immediately deactivate any credentials it has issued to you and bar you from accessing the collections or the site.

Because the collections content comes from around the world and from many different sectors, the collections may contain information that might be deemed offensive, disturbing, pornographic, racist, sexist, bizarre, misleading, fraudulent, or otherwise objectionable. E-Lib4All does not endorse or sponsor any content in the collections, nor does it guarantee or warrant that the content available in the collections is accurate, complete, or legally accessible in your jurisdiction. You agree that you are solely responsible for abiding by all laws and regulations that may apply to viewing the content. Besides, the collections are provided to you on an as-is and as-available basis. You agree that your use of the site and the collections is at your sole risk. You understand and agree that the E-Lib4All makes no warranty or representation regarding the accuracy, currency, completeness, reliability, or usefulness of the content in the collections, that the site or the collections will meet your requirements, that access to the collections will be uninterrupted, timely, secure, or error-free, or that defects, if any, will be corrected. We make no warranty of any kind, either express or implied.

You agree to indemnify and hold harmless E-Lib4All and its parents, subsidiaries, affiliates, agents, officers, directors, and employees from and against any liability, loss, claims, damages, costs, and/or actions (including attorneys fees) arising from your use of E-Lib4All's services, the site, or the collections. 

Under no circumstances, including, without limitation, negligence, shall E-Lib4All or its parents, affiliates, officers, employees, or agents be responsible for any indirect, incidental, special, or consequential damages arising from or in connection with the use of or the inability to use the site or the collections, or any content contained on the site or in the collections, or resulting from unauthorized access to the collections or your transmissions of data, including, without limitation, damages for loss of profits, use, data, or other intangibles, even if E-Lib4All has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you. 

In addition to our academic and historical resources in written, visual, and audio forms, E-Lib4All provides other institutions with e-library portals, a subdomain of ellib.org. Each institution has the right to maintain and control access to materials for its students and other user pools. Institutions must abide by all E-Lib4All policies, including (a) institutions must register users and encourage user self-registration, (b) institutions must encourage users to make maximum use of the electronic resources, (c) institutions must have at least seventy-five percent (75%) of their members registered within three (3) months of the institution signing up for a portal, (d) users must not sell materials on the platform, (e) users must not sell any of E-Lib4All materials, (f) users may post only E-Lib4All-related materials on all E-Lib4Alls social media platforms, (g) users must report any issues observed, including any misuse of E-Lib4Alls system, resources, etc., by email, and (h) users must provide feedback to the E-Lib4All at any time and upon request.

Cancellation/refund

Before any transaction, including borrowing, purchasing, or subscribing to any material or service on E-Lib4All, carefully review your material or service to ensure that it suits what you want, as refunds or exchanges will not be provided. We do not provide credit, refunds, or prorated billing for canceled mid-month or mid-year subscriptions. In such circumstances, you will continue to have access to your subscription until the end of the monthly or yearly billing cycle. E-Lib4All policies prohibit us from issuing exchanges or refunds after a purchase has been finalized. At any time and for any reason, we may provide a refund, discount, or other consideration to some or all of our users (credits). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future under any circumstance. The organization does not ship materials, as all transactions are online. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine at our sole and absolute discretion.

Advertising 

E-Lib4All may allow users and other non-users (third parties) to advertise on its platform. All submitted advertising materials, such as images, links (URLs), manuscripts, books, announcements, etc., must meet our standards and be approved by us. E-Lib4All reserves the right to reject or withdraw advertisements as it deems appropriate.

We may decline to accept advertising that is misleading, inaccurate, fraudulent, makes unfair competitive claims, or doesn't comply with our standards of decency and dignity. 

Advertisements containing but not limited to the following will not be accepted: 

Advocacy/opinion advertising 

• Advertisements that attack, criticize, or demean any individual, race, ethnicity, religion, sex, institution, firm, business, profession, organization, or sexual orientation will not be accepted. Any advertisement that promotes illegal activities or actions is not acceptable.

Cigarettes/cigars/tobacco         

Advertisements for cigarettes, cigars, pipe tobacco, chewing tobacco, and snuff are unacceptable.

Content sensitivity         

• E-Lib4All may decline to run advertisements adjacent to any content it deems sensitive, at the discretion of E-Lib4All.

Firearms         

• Advertisements for firearms, handguns, rifles, and ammunition are unacceptable.

Language and good taste         

• In the opinion of E-Lib4All, any advertisement that is indecent, vulgar, suggestive, or otherwise offensive to good taste is unacceptable.

Political         

• Advertisements that endorse an individual political candidate or political party will not be accepted.
• Advertisements that endorse a non-educational political proposition or policy will not be accepted.
• As an unbiased site, E-Lib4All will accept advertisements for ballot issues that are educational in nature, subject to approval.

Privacy Policy

Collection and Disclosure of Personal Information 

E-Lib4All may collect personally identifying information during user registration, including the users' name, address, telephone number, and email address.

E-Lib4All may use cookies to track users' activities on the site and in the collections. Cookies are small files that a server transfers to the hard drive of someone who visits a site, and the server can access it when the person returns to the site.

The communications between you and E-Lib4All may pass through many other technologies. Some of these technologies create logs of activities that are recorded on computer systems.

E-Lib4All may disclose any information it collects from users if E-Lib4All believes in good faith that such action is reasonably necessary to enforce its Terms of Use or other policies, to comply with the law or legal process, to operate its systems properly, to protect the rights or property of itself, its users, or others, or for research purposes. It is possible that the computers at E-Lib4All could become compromised by others and that the information on E-Lib4Alls computers could be collected and disseminated without the knowledge or consent of E-Lib4All. While E-Lib4All endeavors to block hackers from breaking into its machines, E-Lib4All is not liable for any such unauthorized uses of E-Lib4All or its data.

You may, of course, decline to submit personally identifiable information through the websites, in which case, the organization may not be able to provide certain services to you. You may update or correct your personal information and email preferences at any time by visiting your account profile page.

Copyright Policy 

E-Lib4All respects the intellectual property rights and other proprietary rights of others. E-Lib4All may remove certain content or disable access to content that appears to infringe the copyright or other intellectual property rights of others in appropriate circumstances and at its discretion. If you believe that your copyright has been violated by material available through E-Lib4All, please immediately inform us directly by email.

E-Lib4All provides a digital library portal to various institutions of learning. Each institution has the right to maintain its portal and control access to materials for its students or user pool. Each institution is solely responsible for all activities in its portal. E-Lib4All bears no legal responsibility whatsoever for what happens in other institutions' portals.

Manuscripts

Authors retain ownership rights to their manuscripts and all other materials they submit to E-Lib4All, but they give us the right to put up these manuscripts, in any format of our choosing, on our websites, USB drives, and other software applications where the manuscript could be downloaded and read by our users. You grant E-Lib4All a nonexclusive and royalty-free right to use that content. You also give E-Lib4All users the right to download and read the manuscript. We may add pages to the beginning and end of your book to market it and our site further. We may translate your book into other languages or audio. Finally, you give us the right to use your name and the title of the manuscript in advertisements and promotions and to list the manuscript on the website.

All sales and borrowed manuscripts are subject to E-Lib4All commissions and said commissions are automatically withdrawn after each transaction. E-Lib4All may also charge a monthly or yearly fee for storing manuscripts on its platform.

Authors are confirming to us they own their manuscripts and have the right to upload them to our website. E-Lib4All is not liable if this is not the case. Authors must not submit any work that is defamatory to another person or company, and they must not include any protected materials of third parties (e.g., trademarks, trade secrets, copyrights).

Any manuscript you upload to the site should be in good taste and should not, in any way, contain any illegal or illicit content. Proper use of grammar must be maintained! We reserve the right to remove any manuscript we believe violates the law or is otherwise in poor taste. We are not liable if your manuscript contains illegal or illicit content, and if it does, we will take it down if it is identified. The determination as to what is and is not illicit is up to us. We do not have to explain our rationale if we take down a manuscript for being illicit or containing illegal content.

Changes and updates to this Agreement 

E-Lib4All may modify this Agreement from time to time. Please revisit this page to stay aware of any changes. Your continued use of the collections and/or the site constitutes your acceptance of any modifications.
